1. Introduction

Welcome to ArriveClean (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of the ArriveClean website (arriveclean.com), mobile applications, and all related cleaning services (collectively, the “Services”). By accessing our website or booking a cleaning service, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Services

ArriveClean LLC provides professional residential and commercial cleaning services in San Francisco and San Mateo County, including but not limited to standard cleaning, deep cleaning, move-in/move-out cleaning, and recurring cleaning plans. All services are subject to availability in your area.

3. Booking & Scheduling

3.1. Cleaning services may be booked through our website or any other booking method made available by ArriveClean.

3.2. By placing a booking, you confirm that all information provided (including name, address, contact details, and property details) is accurate and complete.

3.3. A booking is confirmed once you receive a confirmation email or notification from ArriveClean. We reserve the right to decline or cancel any booking at our discretion.

3.4. You agree to provide safe and reasonable access to your property at the scheduled time of service.

4. Pricing & Payment

4.1. All prices are displayed at the time of booking and may vary based on property size, service type, frequency, and any add-on services selected.

4.2. Payment is required at the time of booking unless otherwise arranged. We accept major credit cards, debit cards, and other payment methods as displayed on our website.

4.3. All payments are processed through secure, PCI-compliant third-party payment processors.

4.4. Prices are subject to change at any time. However, confirmed bookings will be honored at the price quoted at the time of booking.

4.5. Recurring cleaning plans (weekly, bi-weekly, or monthly) are billed automatically at the agreed-upon rate. Discounts applied to recurring plans are valid only for the duration of the active plan.

5. Cancellation & Rescheduling Policy

5.1. Free Cancellation: You may cancel or reschedule a booking free of charge if notice is provided at least 24 hours before the scheduled service time.

5.2. Late Cancellation: Cancellations made less than 24 hours before the scheduled service time may be subject to a cancellation fee of up to 50% of the scheduled service cost.

5.3. No-Show: If a cleaner arrives at your property and is unable to gain access or perform the service due to circumstances within your control, the full service fee may be charged.

5.4. Cancellation by ArriveClean: We reserve the right to cancel or reschedule a booking due to unforeseen circumstances, including but not limited to cleaner availability, severe weather, or safety concerns. In such cases, you will be offered a full refund or the option to reschedule at no additional cost.

5.5. Recurring Plan Cancellation: Recurring cleaning plans may be paused or cancelled at any time. No long-term contracts are required. Cancellation of a recurring plan must be made at least 24 hours before the next scheduled service to avoid charges for that session.

6. Satisfaction Guarantee

6.1. ArriveClean is committed to your satisfaction. If you are not happy with the quality of a cleaning service, you must notify us within 24 hours of the completed service.

6.2. Upon receiving your complaint, we will arrange a complimentary re-clean of the affected areas at no additional charge, subject to scheduling availability.

6.3. The re-clean must be completed within 7 days of the original service date.

6.4. The satisfaction guarantee applies to the quality of the cleaning service performed. It does not cover pre-existing damage, stains, or conditions that cannot be resolved through standard cleaning methods.

6.5. Refunds are issued at the sole discretion of ArriveClean and are not guaranteed. We will make every reasonable effort to resolve the issue through a re-clean before considering a refund.

7. Customer Responsibilities

7.1. You agree to provide a safe and hazard-free environment for our cleaning professionals. This includes securing pets, removing valuables, and disclosing any known hazards (e.g., broken glass, biohazards, pest infestations).

7.2. You are responsible for securing fragile, valuable, or irreplaceable items prior to the cleaning service. ArriveClean is not responsible for damage to items that are inherently fragile or improperly secured.

7.3. You agree to ensure that running water, electricity, and adequate lighting are available at the property during the service.

7.4. ArriveClean reserves the right to refuse or terminate a service if the cleaner encounters unsafe, unsanitary, or hostile conditions at the property.

8. Damage & Liability

8.1. ArriveClean carries comprehensive general liability insurance. In the event that our cleaning professional accidentally causes damage to your property during a service, please report the damage within 24 hours of the completed service.

8.2. We will investigate all damage claims promptly. If the damage is determined to be caused by our cleaner during the service, ArriveClean will repair or compensate for the damage at our discretion, up to the limits of our insurance policy.

8.3. ArriveClean is not liable for:
– Pre-existing damage or wear and tear
– Damage caused by defective or improperly installed fixtures, appliances, or surfaces
– Damage to items not disclosed to the cleaner prior to the service
– Indirect, incidental, or consequential damages

8.4. Our total liability for any single claim shall not exceed the cost of the service during which the damage occurred.

9. Independent Contractors

9.1. Cleaning professionals who perform services through ArriveClean may be independent contractors or employees of ArriveClean LLC. Regardless of their classification, all cleaning professionals are vetted, background-checked, and insured.

9.2. You agree not to directly solicit, hire, or engage any ArriveClean cleaning professional for services outside of the ArriveClean platform for a period of 12 months following your last service. Violation of this provision may result in a referral fee of $2,500.

10. Use of Website

10.1. You agree to use our website and Services only for lawful purposes and in accordance with these Terms.

10.2. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

10.3. You agree not to:
– Use the website in any way that violates applicable laws or regulations
– Attempt to gain unauthorized access to any part of the website or its systems
– Use automated tools (bots, scrapers, etc.) to access the website without our express written consent
– Submit false, misleading, or fraudulent information

11. Intellectual Property

11.1. All content on the ArriveClean website, including but not limited to text, graphics, logos, images, and software, is the property of ArriveClean LLC and is protected by applicable intellectual property laws.

11.2. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.

12. Privacy

12.1. Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

12.2. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

13. Gift Cards & Promotions

13.1. Gift cards purchased through ArriveClean are non-refundable and may not be redeemed for cash.

13.2. Promotional discounts and vouchers are subject to specific terms and conditions as stated at the time of the offer. Promotions may not be combined unless expressly permitted.

13.3. ArriveClean reserves the right to modify or discontinue any promotional offer at any time.

14. Limitation of Liability

14.1. To the maximum extent permitted by applicable law, ArriveClean LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services.

14.2. Our total aggregate liability for all claims arising out of or related to these Terms or our Services shall not exceed the total amount paid by you to ArriveClean in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless ArriveClean LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or related to your breach of these Terms or your use of our Services.

16. Dispute Resolution

16.1. Any disputes arising out of or related to these Terms or our Services shall first be resolved through good-faith negotiation between the parties.

16.2. If a dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association.

16.3. These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

17. Modifications to Terms

17.1. ArriveClean reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to our website.

17.2. Your continued use of our Services after any changes to these Terms constitutes your acceptance of the revised Terms.

17.3. We encourage you to review these Terms periodically to stay informed of any updates.

18. Termination

18.1. ArriveClean may suspend or terminate your access to our Services at any time, with or without cause, and with or without notice.

18.2. Upon termination, all provisions of these Terms that by their nature should survive termination shall continue to apply, including but not limited to intellectual property, limitation of liability, and indemnification provisions.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
